Kelly, who was homeless and struggling with drug addiction at the time, admitted she 'got caught up' in the riots, which began after an earlier attack on children and childcare workers. Her defense counsel stated she had no political motivations that night. However, she had a history of 66 previous convictions, including criminal damage, theft, and assault.

The statement emphasized the distress of the 4,000 employees, including approximately 3,100 drivers from 85 countries, whose morale was severely affected. On that day, a total of eight vehicles were damaged, with three being completely destroyed, causing the company a loss of about €1.9 million.
Kelly's defense presented a handwritten apology and highlighted her challenging background, including limited education and drug use. Her counsel explained that she was intoxicated and expressed regret for her actions.
